By virtue of an Order of Sale, directed to me from the Clerk of the Fulton Circuit Court and pursuant to a Judgment of Foreclosure entered on October 12,2012, I will expose to public sale to the highest bidder for cash in hand, at the office of the Sheriff of Fulton County, in Fulton County, Indiana, located at 200 E 8th St, Rochester, IN 46975 on

January 29, 2013 at 10:00 a.m. Local Time, the fee simple title together with the rents, profits, issues and income or so much thereof as may be sufficient to satisfy said judgment, interest, costs and accruing costs of the following described real estate located in Fulton County, Indiana, to-wit:

Commencing at a PK Nail marking the northwest corner of Section 4, Township 31 North, Range 1 East in Aubbeenaubee Township, Fulton County, Indiana, thence South 41.80 feet to a concrete right-of-way marker set on the South right of way line of State Road No. 110; thence easterly along said right-of-way line 695.92 feet to another right-of-way marker, thence continuing easterly along said south right-of-way line having an assumed bearing of North 90 degrees 00 minutes 00 seconds east 518.40 feet to an iron rod set at the point of beginning, thence continuing on the last course 200.00 feet to an iron rod set; thence south 00 degrees 00 minutes 00 seconds west 140.00 feet to an iron rod set; thence south 90 degrees 00 minutes 00 seconds west 200.00 feet to an iron rod set; thence north 00 degrees 00 minutes 00 seconds east 140.00 feet to the point of beginning, containing in said parcel 0.64 acres all as shown on the recorded plat of survey by Russell C. Eck & Associates noted Job No.93-92/2461 and dated 5/12/95 and known as Lot 2 in Countryside Park.

The above described Real Estate is together with and subject to that certain Ingress-Egress easement described in Instrument #200700700297 in the Office of the Fulton County, Indiana Recorder as well as being subject to and together with a certain agreement establishing and for maintenance of the Ingress-Egress easement dated 01-30-2007 and recorded 02-01-2007 as Document # 200700700382.

This sale is to be made in all respects pursuant to an act of the General Assembly of the State of Indiana, approved March 7, 1931, and entitled An act concerning proceedings in actions to foreclose real estate mortgages, providing for the sale and custody of the mortgaged premises and repealing all laws conflicting therewith (see Indiana Code).

It is further provided by law that there shall be no redemption from such sale, and the purchaser at such sale, upon complying with the terms of his purchase, shall be entitled to immediately receive from the undersigned, Sheriff of Fulton County, a deed conveying to him, the purchaser, the fee simple title in and to said real estate.

Taken as the property of the Defendant(s) stated above at the suit of Bank of America, N.A., Successor by Merger to BAC Home Loans Servicing, LP. Said sale to be without relief from valuation and/or appraisement laws.
